Examination of Witnesses on Settlement & removal Order for John Cherry 1846.

WHEREAS, Complaint has been made to us, two of Her Majesty's Justices of the Peace and Churchwardens of Heptonstall, that John Cherry and Ann his wife, Cornelius aged seven years, Jane aged four years and Thomas aged two years, have in the space of five years now last past come to inhabit in the township of Heptonstall, not having gained legal settlement there nor having produced a certificate acknowledging them to be settled elsewhere, and that the said John Cherry and Ann his wife and Cornelius, Jane and Thomas their children become actually chargeable to the said township of Heptonstall and it has now been passed to us the said Justices upon oath that the said John Cherry and Ann his wife and Cornelius, Jane and Thomas their children has nor any of them resided in the Township of Heptonstall five years next before the application for this warrant or order.

We do, therefore, upon due examination of the premises, taken before us on oath, adjudge the same to be true. And, we do likewise adjudge the last place of lawful settlement of the said John Cherry, and Ann his wife and Cornelius, Jane and Thomas their children to be in the said parish of Melbecks.

THESE, are therefore, in Her Majesty's name to require you the said Churchwardens and Overseers of the Poor of Heptonstall to convey the said John Cherry, Ann his wife and Cornelius, Jane and Thomas their children from and out of the said township of Heptonstall to Melbecks aforesaid therein to deliver them to the Churchwardens and Overseers of the Poor there who are hereby required to take care and provide for them.
